1. Purpose and scope
AKARUP is a secure messaging platform using post-quantum encryption to protect communications. The service is intended primarily for professionals, businesses and organizations, and remains available to individuals.
Certain provisions of these terms apply specifically to users acting in a professional capacity; they are identified as such. Consumer users retain all rights guaranteed to them by consumer protection law.
2. Free service
The service is currently provided free of charge and includes:
- •Secure messaging with end-to-end encryption (ML-KEM-768 and ML-DSA-65)
- •Creation and management of conversation groups
- •Technical support by email
Users undertake to use the service reasonably and in accordance with its purpose. AKARE SARL reserves the right to limit or suspend access in the event of excessive, abusive or unlawful use.
3. Blind Relay architecture
AKARUP is built on a "Blind Relay" architecture:
- •Data is encrypted on your device before it is sent.
- •AKARE SARL receives only encrypted data, unreadable without the keys.
- •AKARE SARL holds no decryption key.
- •AKARE SARL cannot technically access the content of your communications: it acts as a mere relay.
4. Liability and data backup
Technical consequence of encryption
Due to the Blind Relay architecture, AKARE SARL holds no decryption key and is technically unable to access, restore or recover the content of your data. You alone hold the keys needed to decrypt your communications.
Backup obligation
Because you are the sole holder of your keys, it is your responsibility to back up your data: export your conversations regularly, keep local copies on your devices, and verify the integrity of your backups. AKARE SARL recommends regular backups.
Limitation of liability
AKARE SARL shall not be liable for data loss resulting from circumstances beyond its reasonable control, in particular the user's loss of their keys or recovery phrase, the voluntary deletion of data, or the failure of the user's devices. As the service is provided free of charge, AKARE SARL's liability is limited to the extent permitted by applicable law. Nothing in these terms shall exclude or limit AKARE SARL's liability in the event of gross negligence or willful misconduct, nor set aside the mandatory rights granted to consumers.
5. Provisions specific to professional users
For users acting in a professional capacity, and to the extent permitted by law, AKARE SARL's liability under the free service is excluded for any indirect damage or data loss. Any dispute relating to the service between AKARE SARL and a professional user shall be subject to the exclusive jurisdiction of the Commercial Court of Versailles.
6. Governing law and jurisdiction
These terms are governed by French law. Consumer users retain the right to bring proceedings before the courts of their place of residence, in accordance with consumer protection law. For any question, contact [email protected].
By using AKARUP, you acknowledge that you have read and understood these terms of service and our privacy policy.
